Lawn Mower and Child Safety, who is really responsible?

Ok, I just read an article about a case involving John Deere and a local distributor.  The case is about how the parents sued John Deere for an accident that occurred involving the plaintiff's child being run over by the lawn mower.

Before I give my thoughts, I would like to know what you think about who is responsible for accident.  John Deere or the father Kurt Norton.
